Please read the following Terms and Conditions carefully as use of our website and purchase of our products means that you agree with them. These Terms and Conditions apply to web site orders only.
1/Shopping with Marechaux.fr
You can order products displayed on this website solely on-line.
If you have placed your order on-line, we will promptly send you an e-mail confirming your order has been received. The email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your orde
2/Prices
We try to make sure that the prices on our website are accurate but because of the orders’ nature we will need to validate the price before we process your order. Subsequently these prices shall be considered as estimates. If we are unable to supply a particular item that you have ordered or if the correct price for an item is different from the price on your order, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you any money that you have paid.
The prices on our website will remain valid until such time as we decide to alter them.
You will be notified of shipping costs automatically before you submit your credit card details.
Prices are exclusive of Value Added Tax or any other duties or taxes which may be chargeable on any goods provided to the Buyer and which shall be paid bythe Buyer at the rate and in the manner for the time being prescribed by law.
3/Payment
You can pay with any Visa Card or MasterCard via our secured BNP PARISBASTM bank system (to ensure that shopping on-line is secure, your credit/debit details will be encrypted to minimise the possibility of someone being able to read your details as they are sent to us over the Internet).
The prices displayed on our website are in Euros. You may use our "currency converter" tool to estimate the price of goods in other currencies. The "currency converter" is based on the current exchange rate against the ounce of gold. This tool is for information only and shall not bind Maréchaux SAS.
4/Delivery
1. The mode of dispatch and the dispatch type sequence will be determined by Maréchaux SAS. Because of the orders’ nature Maréchaux SAS cannot guarantee any delivery time at the time of the order.
2. Delivery times are subject to confirmation. If, however, delivery times have been agreed upon in writing they will be kept to the best of Maréchaux SAS’ possibilities. All delivery times shall start to run on the date of completion/assembly at our factory/storage.
3. The delivery time can be reasonably extended,
a. if the Buyer alters such information at a later date and therefore causes a delivery delay.
b. if Maréchaux SAS is prevented from delivering the goods due to “force majeure” as described in paragraph 6
c. if the dispatched goods require a special licence as a cites of the convention of Washington.
5/Passing of Risks and Costs
In case the Buyer refuses to accept the goods, the passing of risk has moved to the Buyer at the time of the refusal. At the same time the purchase price has to be paid immediately. Furthermore, Maréchaux SAS is entitled to claim any expenses from the Buyer which he incurs or might incur in the future due to delayed acceptance of the goods, for example default interest, costs for storage and transport, …
6/Force Majeure
Maréchaux SAS is not liable for the consequences of circumstances beyond its reasonable control including wars, natural disasters, boycotts, strikes, failure of supplies of power, fuel and raw materials or similar events. In the event of any such event, the Buyer is entitled to withdraw from the contract (or to suspend its execution). No claim for damages can be made. This clause applies as well if subcontractors, without any fault of Maréchaux SAS, do not fulfil their delivery obligations in time or if normal means of procuring goods or transporting them are interrupted.
7/ EXPORT CONTROLS
Products purchased or received under these Terms and Conditions of Sale are subject to export control laws, restrictions, regulations and orders of France. The Buyer agrees to comply with all applicable export laws, restrictions and regulations of France. or other foreign agencies or authorities, and shall not export, or transfer for the purpose of re-export, any product to any prohibited or embargoed country or to any denied, blocked, or designated person or entity as mentioned in any such France, or foreign law or regulation.
8/Our responsibility
Maréchaux SAS shall not be held responsible for any loss resulting from the Buyer’s use or inability to use the website or resulting from unauthorised access to, or alteration of transmissions or data in circumstances which are beyond Maréchaux SAS’ reasonable control.
Maréchaux SAS shall not be held responsible for loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from Maréchaux SAS’ failure.
The Buyer shall be held responsible if it uses this website in breach of these terms of use and shall pay damages for any loss resulting from its misuse.
We make no promise that our website will be uninterrupted or entirely error free. Because of the nature of the Internet, the shopping online service is provided on an "as is" and "as available" basis. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.
9/ Warranty
All sales are subject to the general terms of trade and conditions for veneer or timber or sawn wood.
Differences in the colour of the wood, which is a natural product, do not constitute a defect within the framework of any warranty agreements. In the case of veneers, a possible variance in thickness up to 5 % has to be tolerated. The contractual measurement is the measurement with which the veneer has been sliced or peeled. The surface area is calculated electronically. A possible variance has to be tolerated up to 5 % of the overall surface area
10/Description
All specifications, drawings, illustrations, descriptions and particulars of weights, dimensions or capacity and other details including, without limitation, statements regarding compliance with legislation or regulation (together "Descriptions") wherever they appear (including, without limitation, in catalogues, on web sites, on dispatch notes, invoices or packaging) are intended to give a general idea of the products, but will not be contractually binding. We may change or withdraw any part of our website, or may refuse you access to the website at any time if we consider it necessary.
The laws of French govern these terms and conditions, and only the courts of creteil 94 in France will decide any disputes.
Your statutory rights are not affected by anything contained within these terms and conditions.
14/Place of Jurisdiction and Applicable Law
1. Any contract incorporating these Terms and Conditions shall in all respects be governed by and construed in accordance with French law.
2. Any disputes arising from this contract shall be settled before a competent court of law at Maréchaux SAS’ place of residence. Maréchaux SAS is entitled to prosecute the Buyer at his place of residence.
3. The place of jurisdiction is Créteil 94 France
